Terms
These terms govern your use of the Duel service, operated by Duel Limited (NZBN to be assigned), a New Zealand limited-liability company. By creating an account or signing a contract on Duel, you agree to these terms.
1. What Duel is
Duel is a facility for creating binding behavioural-commitment contracts with a monetary stake. You stake your own money against a standard you define — for a fixed duration and measured against pre-agreed daily or weekly points. Points you pass return your stake; points you miss forfeit a proportional slice.
2. Eligibility
You may use Duel only if you are:
- at least 18 years old;
- ordinarily resident in New Zealand or Australia;
- legally able to transact, and the bank account or card you use is yours;
- staking only money you can afford to lose in full.
3. Your contract is with yourself, or with another individual
In solo mode, your contract is with yourself, with Duel Limited acting only as facilitator and escrow agent. In duel mode, your contract is with the other named individual. Duel Limited is a party to neither commitment; it merely operates the rails.
4. Stakes are non-refundable once authorised
You authorise your stake before the contract begins. Once the contract is live, the stake is held in escrow and moves strictly according to the rules you signed. Points missed forfeit a real and final slice of your stake. No slice can be refunded, including on change of mind.
5. Fees
Duel charges no setup fee. Duel earns a fixed percentage of forfeited points, disclosed on the review screen before you sign. Passed points return to you at settlement net of unavoidable payment-processor fees (typically ~2% on NZD card transactions).
6. Accuracy of information
You agree that the personal information you provide is accurate, that any self-reported pillar data (for example, alcohol-free days) is honest, and that you will not deliberately disable health-data tracking to avoid a missed point. Fraudulent self-reporting voids the point at Duel Limited’s discretion and may void the contract.
7. Termination
You may withdraw from a contract at any time. Doing so forfeits all remaining points from that moment. Duel Limited may suspend or terminate your account if it has a reasonable belief that you are using the service fraudulently, abusively, or in breach of these terms; any active contract will be settled at its then-current score.
8. Liability
Duel Limited’s maximum liability to you arising out of or connected to the service is limited to the total amount of fees it has collected from you in the 12 months preceding the claim. Duel is not liable for consequential losses, lost opportunities, or missed points caused by connected health-device outages.
9. Changes
We may amend these terms for contracts signed after the amendment date. Contracts already signed continue under the terms in force at the time of signing.
10. Governing law
These terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any matter arising out of these terms that is not resolved through the dispute process.
